Burn Terms

Draft for legal review, not final. Version 2, updated 2026-10-12. Burn LLC, Colorado.

Who we are

Burn is a text-message accountability service run by Burn LLC, a Colorado company ("Burn", "we", "us"), offered in the US. These terms and our Privacy Policy are the whole agreement between you and us. By replying YES to Burn's first message, you confirm you are 18 or older, agree to receive automated texts from Burn, and agree to these terms, including the arbitration section below.

Who can use Burn

You must be 18 or older and in the US. If you are under 18, don't use Burn. If we learn someone under 18 is using it, Burn stops texting them and deletes their data.

Texting

You text Burn first. Burn never texts a number that hasn't. Until you reply YES, Burn sends you only its first message, asked once more at most, and its answers to STOP, HELP, delete my data or a message that reads like a crisis.

Most of Burn's texts are replies to yours. Burn also texts first: check-ins on the days you say you'll do something, a recap on Sunday, and a nudge when you go quiet. Once Burn has sent you 50 texts in a day, it doesn't start another that day. Message and data rates may apply.

Text STOP, or ask in plain words ("stop texting me", "unsubscribe me"), and Burn stops. You get one text confirming it, and after that only answers to HELP, delete my data or a message that reads like a crisis, until you text START. Text HELP for what Burn is and how to stop. We keep when you agreed and when you stopped.

Burn won't send you texts that sell or promote anything unless you have separately agreed in writing to receive them. That agreement is never a condition of using Burn, and you can take it back by texting STOP.

Burn is an AI

Burn's texts are written by an AI, not a person. Ask Burn if it's a bot and it tells you the truth. Burn can be wrong: about what you said, what you did, or anything else. Check anything that matters.

If you tell Burn you're in New York, Burn also texts you this when you start, and again whenever you've kept texting for three hours since it last did, as New York law requires:

BURN IS A COMPUTER PROGRAM AND NOT A HUMAN BEING. IT IS UNABLE TO FEEL HUMAN EMOTION.

What Burn does

You text Burn what you plan to do and what you did. Burn keeps track, holds you to it, and gives you a hard time when you slack. Being roasted is entertainment you chose. It's a comedic bit, about the choice, never a judgment of you as a person.

Burn swears by default. It gets harsher only if you ask, by texting go harder or no mercy. If Burn isn't good for you, turn it down, pause it or stop it, and don't keep using it.

You're in control

What Burn won't joke about

Burn won't roast your body, weight, appearance, eating, race, ethnicity, gender, sexuality, religion, disability, a family crisis or your health. When you give a real reason, like being sick, hurt or dealing with family, Burn drops the bit.

Not advice

Burn is not medical, mental health, nutrition or fitness advice, and it is not a substitute for a doctor, therapist or trainer. See a doctor before starting a new exercise program. In an emergency, call 911. If you're thinking about hurting yourself, call or text 988.

If you're in crisis

If you text something that sounds like you might hurt yourself or are in serious distress, Burn stops the bit, sends you the 988 Suicide & Crisis Lifeline and the Crisis Text Line, and doesn't text you first for 7 days. A person at Burn may review that exchange. Burn is not a crisis service, and nobody watches your texts as they come in. The whole protocol is on our crisis page.

Your part

Don't use Burn to harass anyone, to send threats, hate or sexual content, to send anything illegal, or to give Burn someone else's number without their OK. Don't try to make Burn say what its rules forbid. We may stop providing Burn to anyone who does, by stopping their texts, with or without notice.

Friends and witnesses

If you join friends on Burn, they see the name you pick, your count this week and your streak. They never see your number or your messages.

If you ask a friend to be your witness, Burn never texts them unless they text Burn first and agree. After that, Burn may text them when you go quiet. Only name people who are fine hearing from Burn.

Sharing

Text card and Burn sends you a picture of your last exchange with it. A card never includes another member's messages or a phone number. It shows your friend code, so people who see it can join your crew. What you post is your post and your responsibility.

Your messages

Your messages are yours. You let us use them to run Burn for you, and to improve Burn in a form that no longer identifies you.

Price

Burn is free. Nothing is charged, so there is nothing to refund. If we ever start charging, we'll text you at least 14 days before, and nothing is charged unless you choose to pay. You can cancel anytime by texting STOP, and it takes effect right away.

No warranty, and limits

Burn is provided as is and as available, without warranties of any kind, as far as the law allows. Burn LLC isn't liable for indirect, incidental or consequential damages, and its total liability to you is limited to what you paid us, which today is nothing. You agree to cover Burn LLC's costs from claims caused by your misuse of Burn or your breaking these terms.

Arbitration and class action waiver

Please read this section. It affects your rights. Colorado law governs these terms. Any dispute between you and Burn LLC is settled by binding individual arbitration, not in court, except that either of us may bring an individual claim in small claims court. You and Burn LLC each give up the right to a jury trial and to bring or join a class or representative action.

You can opt out of this section by emailing help@textburn.app within 30 days of first agreeing to these terms, with the number you text Burn from and a line saying you opt out of arbitration. Opting out changes nothing else.

Changes

When these terms change in what you agreed to, Burn texts you once, the next time it replies to you, with the links, and asks you to reply YES to the new terms. They take effect for you on the day you reply YES. Until then, the terms you agreed to before still apply, and nothing about Burn changes for you. If any part of these terms can't be enforced, the rest still applies.
